Terms and Conditions:

If and insofar as the following subjects are not governed by mandatory law and/or specifically dealt with in a written framework contract between Sima Charters BV and its principal, the following applies:

i) to all Sima's services, Dutch law applies; the Rotterdam District Court has exclusive jurisdiction to judge claims against Sima, and optional jurisdiction to judge claims from Sima who therefor also is entitled to file its claims with the otherwise competent courts;

ii) to determine whether or not it is safe to sail is to the sole discretion of Sima and/or the master of the relevant vessel; iii) any and all liability of Sima, for any possible consequences of any possible type of loss or damage or delay and in relation to any possible type of services performed or intended to be performed by Sima, is fully excluded; iv) Sima's principal to hold Sima harmless against any claims from third parties in relation to services performed or intended to be performed by Sima, and against any costs of defense against such claims.
